Government Litigation

Attorneys at Whatley Drake & Kallas have vast experience in representing state and local governmental entities in various kinds of complex litigation. In this time when all governmental entities are experiencing severe fiscal problems, it is imperative that state and local governmental entities pursue claims to recover and prevent excessive and improper charges. Only through such aggressive action can state and local governments protect the taxpayers and preserve the principle that every taxpayer's dollar is sacred.

Whatley Drake & Kallas has been in the forefront of the litigation to prevent improper practices by prescription drug companies and to recover funds for public and private payers when drug companies engage in antitrust violations and other improper conduct resulting in excessive prices. For example, Whatley Drake & Kallas was one of lead counsel in In re Lorazepam and Clorazepate Antitrust Litigation, MDL 1290, United States District Court, District of Columbia, where approximately $100,000,000 was recovered. Whatley Drake & Kallas is also currently active in a number of other class actions against prescription drug companies.

Joe Whatley has represented the public historically black universities in the state of Alabama in desegregation litigation that has resulted in the recovery of tens of millions of dollars by those universities. Attorneys at Whatley Drake & Kallas were appointed by the Attorney General of the State of Alabama and represented the public universities in the state in the recovery of excessive charges from booksellers.

Whatley Drake & Kallas is currently investigating and working together with a number of other law firms to assist states in the recovery of unclaimed property. Whatley Drake & Kallas believes that life insurance companies as well as others have failed to pay over to the states amounts required by the Uniform Unclaimed Property laws adopted by almost every state.
